These Terms of Use apply to knyawcapital.com and to the KC Prime software, installation and support services offered by Knyaw Capital (“we”, “us”). By using this site or buying KC Prime, you agree to these terms. The License Terms and Refund Policy form part of these terms.

1. What we provide

Knyaw Capital provides trading software for NinjaTrader 8, installation assistance and optional ongoing support. We are not a broker, a futures commission merchant, a commodity trading advisor or a registered investment adviser. We do not hold, manage or have access to your funds, and we do not trade on your behalf.

2. No investment advice

Nothing on this site, in the software or in any communication from us is investment, financial, tax or legal advice, or a recommendation to buy or sell any security or futures contract. You decide whether to use KC Prime, on which account, with what balance and with which settings.

3. Risk

Futures trading involves substantial risk of loss and is not suitable for every investor. You can lose more than your starting balance. Automated trading adds further risks, including software errors, platform or data-feed failures, internet, VPS or broker outages, and orders that fill at prices different from those expected. You are solely responsible for the trades placed on your account and for all resulting gains and losses.

4. Hypothetical results

Results shown on this site are hypothetical backtest results. They do not represent actual trading and were prepared with the benefit of hindsight. Past results, whether real or backtested, do not guarantee future results, and no representation is made that any account will achieve profits or losses similar to those shown.

5. Your responsibilities

• Opening, funding and maintaining your own NinjaTrader futures account, and complying with your broker’s terms.
• Providing and paying for a suitable computer or VPS, internet connection and any third-party services.
• Monitoring your account and confirming that NinjaTrader and KC Prime are connected and running, unless you have an active ongoing support plan, in which case we perform a daily connection check as described on our pricing section. A daily check does not guarantee that every outage will be found or fixed in time.
• Keeping your license key, VPS and broker login details secure.

6. Payments and support

The KC Prime license is a one-time payment. The first 30 days of support are included. Ongoing support after that is an optional monthly subscription that you can cancel at any time; cancellation takes effect at the end of the current paid month. Prices are shown on this site and may change for future purchases. All sales are final as set out in our Refund Policy.

7. Intellectual property

KC Prime, this site and their content are owned by Knyaw Capital and protected by intellectual property laws. Your use of the software is governed by the License Terms. You may not copy, resell or republish our content or software without our written permission.

8. No warranty

The site, the software and our services are provided “as is” and “as available”, without warranties of any kind, express or implied, including any warranty of merchantability, fitness for a particular purpose, profitability or uninterrupted, error-free operation.

9. Limitation of liability

To the fullest extent permitted by law, Knyaw Capital will not be liable for any trading losses, lost profits, or indirect, incidental, special or consequential damages arising from your use of the site, the software or our services. Our total liability for any claim is limited to the amount you paid us in the 12 months before the claim arose.

10. Indemnity

You agree to indemnify and hold Knyaw Capital harmless from any claims, losses or expenses arising from your use of the software, your trading activity or your breach of these terms.

11. Changes

We may update these terms from time to time. The date at the top of this page shows when they last changed. Continued use of the site or software after a change means you accept the updated terms.
